Emberz Terms & Conditions

These Terms & Conditions govern your access to and use of Emberz’s website, online store, physical retail locations, programs, and services. By accessing, browsing, purchasing from, or interacting with Emberz in any manner, you agree to be bound by these Terms.

 

Please review the information below carefully, as it outlines your rights, responsibilities, and the conditions under which Emberz operates.

If you do not agree to these Terms and Conditions, you should discontinue use of Emberz’s services.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Emberz Retail LLC, doing business as Emberz Smoke Shop and Emberz (“Emberz,” “we,” “us,” or “our”), governing all access to, interaction with, and use of:

  • Emberz’s websites and online store, including emberzct.com

  • Emberz customer accounts, digital features, and online tools

  • Emberz’s physical retail location(s)

  • Emberz programs, memberships, subscriptions, rewards, loyalty systems, and payment plans

  • Emberz community platforms, cultural programs, events, experiences, and media initiatives

  • All products, content, services, and communications offered or facilitated by Emberz​ (collectively, the “Services”).

By visiting, browsing, accessing, registering, purchasing from, subscribing to, booking, participating, submitting content, joining programs, or otherwise interacting with Emberz in any manner—whether online, in-store, or through any Emberz-operated platform—you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

You agree that you will contact Emberz exclusively through the official channels listed on emberzct.com (including the Help Center, official forms, email, phone, and the site chat widget). Requests sent through unofficial channels, personal accounts, or third‑party platforms may not be monitored, received, or responded to and do not constitute valid notice to Emberz.

 

2.) DEFINITIONS (KEY TERMS)

For clarity, consistency, and enforcement, the following definitions apply throughout these Terms:

  • “Services”: All Emberz-operated websites, online store functionality, customer accounts, digital tools, loyalty programs, community features, content, events, and physical retail operations.

  • “Store”: Any Emberz physical retail location.

  • “Site”: emberzct.com and all official Emberz subdomains and pages.

  • “Account”: A registered Emberz customer account used to access features, track orders, and participate in programs.

  • “Order”: Any purchase transaction, whether online or in-store, including shipping orders, pickup orders, holds, layaway, protection plans, and program-related purchases.

  • “Pickup / In-Store Pickup”: Orders purchased online and collected at an Emberz Store.

  • “Shipping”: Orders delivered via a third-party carrier.

  • “Processing Time”: The time Emberz requires to verify, prepare, and ready an order for shipment or pickup.

  • “Delivery Time”: The carrier’s transit time after the order has been accepted by the carrier.

  • “Final Sale / All Sales Final”: Purchases that are not eligible for refunds or returns except as expressly stated.

  • “Emberz Memberz”: Emberz’s rewards and membership ecosystem, including points, tiers, perks, and related benefits.

  • “Stash Cash Layaway Program”: Emberz’s layaway and installment payment program.

  • “The Reserve”: Emberz’s Free 24-Hour Product Hold feature, subject to eligibility and restrictions.

  • “The Smoke Society”: Emberz’s community groups and interactive social features.

  • “Emberz Radio”: Emberz’s curated music and culture platform.

  • “Emberz Hall of Fame”: Emberz’s curated archive recognizing select artists, content, or cultural moments.

  • “The Emberz Smoke Museum”: Emberz’s public-facing digital gallery experience.

  • “Emberz Flame Guard / Glass Protection Plan”: Emberz’s optional glass protection plan and related claims process.

  • “Abuse / Website Abuse / Program Abuse”: Any fraudulent, deceptive, exploitative, disruptive, or policy-circumventing conduct, as detailed in Section 35 (Emberz Policies: Store Conduct, Policy Enforcement, & Website Abuse) and related enforcement sections.

 

3.) Scope of Services

Emberz provides retail products, digital services, loyalty and rewards programs, subscriptions, community platforms, promotional offerings, events, experiences, and related customer services through both online and in-store channels (collectively, the “Services”). 

 

Emberz reserves the right to and may modify, replace, suspend, restrict, or terminate any part of any individual program, promotion, subscription, loyalty structure, or benefit independently of other Services at any time without notice.

 

4.) Agreement To Terms; Use at Your Own Risk

By using the Services, you acknowledge that:

  • Your use is voluntary and at your own risk.

  • You are solely responsible for ensuring that your use of the Services, purchases, and interactions comply with all applicable federal, state, and local laws.

Emberz does not guarantee that the Services will be uninterrupted, error-free, or suitable for your specific purposes.

 

If you do not agree to these Terms, you must not use the Services.

5.) Governing Law

These Terms are governed by the laws of the State of Connecticut. Exclusive venue lies in state or federal courts located in Connecticut, unless otherwise required by law. 

6) Age Restrictions; ID Verification; Right to Refuse Service

Emberz’s products, services, subscriptions, and experiences are intended only for individuals who are legally permitted to purchase or participate under applicable federal, state, and local laws.

 

By using the Services, you represent and warrant that you meet all applicable age requirements:

 

6.1 Age Requirements

  • 21+ required to participate or purchase age-restricted products and to receive or pick up certain orders.

  • Emberz may impose age verification requirements on any order, feature, or interaction as permitted by law.

  • You will not provide false or misleading information regarding your age or identity

 

6.2 Identification & Verification

Emberz may require valid government-issued photo identification for:

  • In-store purchases

  • In-store pickup orders

  • Curbside orders

  • Certain shipped orders requiring verification (including signature/adult signature deliveries where required)

  • Any situation where legal or compliance verification is necessary.

Identification that is invalid, expired, altered, inconsistent, or unverifiable may result in refusal of service.

 

Emberz reserves the right to verify age, request identification, restrict access, or refuse service at any time.

6.3 No Straw Purchases / Third-Party Pickup Prohibited

Pickup orders may only be collected by the eligible buyer consistent with Emberz’s verification rules. Emberz may deny pickup if it reasonably suspects third-party pickup, straw purchasing, or policy circumvention.

7.) No Cannabis / THC / Controlled Substances

Emberz is not a cannabis dispensary and does not sell marijuana, THC, delta-8, delta-9, or any controlled substances. Attempts to solicit, request, or facilitate illegal products may result in refusal of service, account termination, and possible reporting where required or permitted by law.

8.) Account Registration & Responsibilities

Certain features may require account creation.

You agree to:

  • Provide accurate and complete information and keep it updated

  • Maintain the confidentiality of login credentials

  • Accept responsibility for all activity under your account

Emberz reserves the right, at its sole discretion, to suspend, restrict, or terminate any account or access to the Services at any time, with or without notice, for reasons including suspected misuse, abuse, fraud, safety concerns, policy violations, or legal compliance requirements.

 

Emberz is not responsible for losses arising from unauthorized account access caused by user negligence.

 

9.) Electronic Communications 

Consent to receive electronic communications is required for use of certain Services and may be withdrawn only as permitted by applicable law.

By using the Services, you consent to receive electronic communications from Emberz, including transactional emails, order updates, account notices, and policy-related communications. Electronic communications satisfy any legal requirement that such communications be in writing.

Message and data rates may apply where SMS or text communications are used.

 

10. User Conduct & Lawful Use

Use of the Services is conditioned on lawful, responsible, and respectful conduct. Users may not engage in conduct that is illegal, harmful, abusive, fraudulent, deceptive, disruptive, or unsafe, including but not limited to misuse of products, systems, promotions, subscriptions, community features, or events.

 

Emberz reserves the right, at its sole discretion, to restrict, suspend, or terminate access to the Services, accounts, programs, or offerings where misuse, abuse, safety concerns, violations of law, or violations of these Terms are suspected or identified.

 

Misuse or manipulation of loyalty programs, including Emberz Memberz or the Vape Loyalty Program, constitutes a violation of these Terms and may result in loss of rewards, account restrictions, or permanent disqualification.

 

11.) Orders, Pricing, Taxes, Fees, & No Price Guarantee

11.1 Availability 

All products are subject to availability.

 

11.2 Order Modification Rights

Emberz reserves the right to:

 

  • Limit quantities

  • Refuse or cancel orders

  • Correct pricing, typographical, or listing errors

Order confirmation does not guarantee acceptance.

 

Orders submitted constitute an offer to purchase and may or may not be cancelled once processing has begun.

11.3 Pricing

Prices, descriptions, and promotions may change at any time without notice due to availability, market conditions, supplier changes, promotions, and management discretion. Emberz does not guarantee price consistency.

11.4 Taxes

You are responsible for applicable taxes. Online and in-store totals may differ due to tax rules and order composition.

11.5 Additional Fees (Including Customs / Carrier / Government Fees)

If any government, carrier, or third-party fees apply (including but not limited to additional carrier expenses, duties, customs, surcharges, government fees, intercept fees, address correction fees, or similar), such fees may be your responsibility unless Emberz expressly states otherwise in writing.

12.) Order Process; Acceptance; Order Locking; Errors

12.1 Order Confirmation Is Not Acceptance

An order confirmation acknowledges receipt, not final acceptance. Emberz may cancel or limit orders due to: pricing errors, inventory issues, fraud risk, compliance concerns, misuse, or operational limitations.

12.2 “Locked for Processing” / Final for Processing

 

Cancel/change requests are not guaranteed, especially after an order is locked for processing or shipped.

An order may become “locked for processing” once:

  • Payment is authorized/confirmed, and

  • Fulfillment steps begin (picking/packing, prep, carrier label generation, queueing, or readiness work)

 

Once an order is locked for processing, Emberz may not be able to modify items, addresses, fulfillment methods, promotions, or cancellations.

12.3 Errors & Corrections

 

Emberz may correct pricing, listing, or inventory errors, including after an order is placed, and may cancel/refund accordingly.

12.4 Order Cancellation & Limitations

 

Emberz may cancel or limit orders due to errors, inventory issues, fraud risk, compliance concerns, or misuse.

13.) Shipping, Pickup & Fulfillment

13.1 Where Emberz Ships

 

Emberz ships to the United States, including all 50 states + Washington, D.C., and Puerto Rico, subject to product eligibility and carrier restrictions.

 

13.2 Shipping Minimum

 

A minimum order total of $35 (pre-tax) may apply for shipped orders as posted in Emberz’s shipping rules.

 

13.3 Pickup Minimum

 

A minimum order total of $5 (pre-tax) is required to be met for pickup and/or in-store purchases as posted.

 

13.4 Shipping Eligibility Determined by Emberz

 

Not all products qualify for shipping due to legal, regulatory, size, fragility, carrier rules, supplier rules, or Emberz operational rules. Emberz may restrict shipping eligibility at any time.

13.5 Shipping Rates & Calculation

Shipping is calculated at checkout based on destination, product category, weight, dimensions, packaging needs, delivery profiles, and carrier pricing.

13.6 Shipping Fee “Stacking” (Multiple Delivery Profiles)

If items in your cart fall into different delivery profiles, shipping charges may “stack” or combine across profiles due to platform and/or carrier rating rules. Emberz does not guarantee a single flat rate.

13.7 Large / Fragile Items

Large, heavy, bulky, or fragile items may cost more due to packaging requirements and carrier dimensional pricing.

13.8 Shipping Rate Changes

Shipping rates can change before or after checkout if: carrier rates change, address is corrected, package specs change, or an error occurred. Emberz may contact you for approval or may cancel/refund if necessary.

13.9 ADDRESS ACCURACY; UNDELIVERABLE PACKAGES

You are responsible for accurate address details. If a shipment is returned due to address issues, refusal, or undeliverable status, Emberz may require additional shipping payment for reshipment and may deduct costs from any refund where refunds are legally required.

14.) Shipping Timelines; Processing VS Delivery; No Guarantees

14.1 Processing Time vs Delivery Time

Processing time is internal preparation time; delivery time is carrier transit time. Carrier delays do not extend or change processing status.

14.2 No Guaranteed Timelines

All estimated order fulfillment timelines and delivery windows are estimates only. Emberz is not liable for delays caused by carriers, weather, volume surges, force majeure events, or events beyond Emberz’s control.

14.3 Multiple Packages

Orders may ship in multiple packages due to inventory location, supplier fulfillment, packaging, or carrier limitations.

14.4 Force Majeure

Risk of loss transfers upon carrier acceptance or pickup completion. Emberz shall not be liable for any delay, failure, interruption, or inability to perform resulting from events beyond its reasonable control, including but not limited to those listed in Section 47 (Force Majeure).

14.5 Shipment Tracking

Tracking is provided when available after carrier acceptance. Carriers may not update tracking immediately after label creation.

14.6 Signature / Adult Signature

Emberz may require signature or adult signature depending on product type, legal requirements, order value, fraud risk, or carrier rules.

14.7 Order Status & Notifications

Order status updates may lag.

Pickup readiness notifications may be delivered via email, SMS text message, and/or account status.

15.) Shipping Insurance/Protection & Risk of Loss

15.1 Insurance / Protection

Where offered, shipping insurance or protection may be included as a precaution against loss or damage in transit, subject to carrier and insurer terms. Insurance does not guarantee replacement; claims require documentation and eligibility.

15.2 Risk of Loss Transfer

To the fullest extent permitted by law, risk of loss transfers upon:

  • Carrier acceptance for shipped orders, or

  • Successful pickup for pickup orders.

 

15.3 Lost, Stolen, or “Delivered But Not Received” Packages

If tracking shows delivered but you did not receive the package, you must:

  • Verify address details

  • Check for secure drop locations

  • Contact your local carrier facility

  • Notify Emberz promptly through official channels

Repeated claims of non-receipt, suspicious patterns, or unverifiable assertions may be treated as abuse and may result in refusal of service or account restrictions as detailed in Section 35 (Emberz Policies: Store Conduct, Policy Enforcement, & Website Abuse).

16.) Pickup Orders; Pickup Restrictions; Ship-Only Items

16.1 Pickup Rules

Pickup orders require:

  • Eligible item(s)

  • Confirmed order

  • ID verification when required

  • Compliance with posted pickup window rules

16.2 Ship-Only Items Cannot Be Picked Up

Certain items that must be shipped (including items sourced/produced/manufactured by third parties or items designated as ship-only) cannot be picked up in store.

If an accommodation is requested, you must contact management. Approval is not guaranteed. If approved, shipping and handling fees still apply and must be paid.

16.3 Pickup Completion

Once picked up, the order is considered delivered and completed, subject to the All Sales Final policy and any limited defect review policies.

17.) Products, Inventory, and Fulfillment Sourcing

17.1 Inventory Not Guaranteed Until Fulfillment Confirmation

Inventory may change rapidly. Emberz may cancel/refund if an item becomes unavailable.

17.2 Third-Party / Drop-Ship / External Fulfillment

Some items may ship from third-party suppliers or partners and may have different processing times, packaging, or shipment origin.

17.3 Supplier Non-Fulfillment

If a supplier cannot fulfill, Emberz may cancel/refund, substitute (with your consent where required), or delay. Emberz is not liable for supplier discontinuations.

18.) Orders: Holds, The Reserve, and Availability

18.1 Holds & The Reserve

Holds are a courtesy service and do not guarantee purchase availability.

 

The Reserve (Free 24-Hour Product Hold) may be available for both in-store and online items depending on eligibility, fulfillment method, and availability.

Certain products—including limited releases, third-party fulfilled items, or ship-only items—may have restrictions or may not qualify. Eligibility is determined by Emberz’s discretion and may vary by item.

 

18.2 Hold vs Layaway

 

A hold is short-term courtesy. Layaway is a payment-plan arrangement with separate rules (see Section 26 – Stash Cash Layaway Program). Holds do not create layaway rights.

18.3 Failure to Pick Up in Time

 

If you do not pick up within the required window, Emberz may release the item and cancel the hold.

18.4 Why Shipping and Pickup Cannot Be Mixed in One Order

If platform limitations prevent mixed fulfillment, you must place separate orders.

19.) Returns; Refunds; Exchanges; All Sales Final

19.1 All Sales Final

All sales are subject to the Emberz "All Sales Final Return & Refund Policy" unless Emberz expressly provides a limited exception, which is incorporated by reference.

19.2 Emberz Refusal Rights:

Emberz reserves the right to deny returns, refunds, or exchanges where abuse, fraud, or policy violations are suspected.

19.3 Exchanges / Store Credit (If Offered)

If Emberz offers exchange/store credit on select items or under specific conditions, it is subject to strict eligibility rules and management discretion, and does not create a general right to returns.

19.4 Opened/Used Items

Opened, used, altered, or damaged items are not eligible for return/exchange except as explicitly stated.

19.5 Accidental Damage

Accidental damage is not covered and generally does not qualify for exchange or replacement under the Emberz All Sales Final policy—unless covered under the Emberz Glass Protection Plan (Emberz Flame Guard) and approved through that process.

19.6 Factory Defect Definition and Review

A “factory defect” is a manufacturer-origin issue present at time of sale (not damage from use, misuse, drops, water exposure, improper charging, modification, or normal wear).

19.7 Time Limit to Report Factory Defects (Strict)

Factory defects must be reported within:

  • 24 hours from purchase time for in-store purchases and online orders picked up in store, and

  • 24 hours from delivery receipt for shipped orders.

Late reports may be denied.

19.8 Proof of Purchase

Proof of purchase is required for any defect review, claim, or exception consideration.

19.9 Order Cancellations & Restocking Fees 

Orders cancelled after processing, fulfillment, preparation, or dispatch may be subject to a delivery and restocking fee of up to $20, depending on the order status, fulfillment stage, and associated costs incurred.

Any applicable fees may be deducted from an approved refund and are intended to cover handling, processing, logistics, and administrative expenses. Emberz reserves the right to waive or adjust fees at its sole discretion.

20.) Payments, Disputes, and Chargebacks

20.1 Payment Authorization & Billing

  • Payments may be authorized and captured at different times depending on fulfillment steps.

  • Payments are processed through third-party payment providers. Emberz does not store full payment card details.

  • You agree to provide valid payment information and authorize applicable charges, including taxes, fees, shipping, and recurring charges where applicable.

20.2 Chargebacks Instead of Contacting Emberz

If you dispute a charge with your bank instead of contacting Emberz, Emberz may:

  • Suspend support on the disputed order while investigation is pending

  • Restrict account access

  • Require additional verification for future orders

  • Treat repeated disputes, false claims, or abuse as grounds for refusal of service (see Section 35.1 – Right to Refuse Service / Remove Individuals).

Emberz encourages you to contact Customer Support first for resolution.

21.) Store Credit, Gift Cards, Promotions, and Gifts with Purchase

 

21.1 Gift Cards

Gift cards may have limitations (online vs in-store use), may be non-refundable, and may be subject to verification and anti-fraud controls.

 

21.2. Gift Cards & Store Credit

Gift cards, digital credits, and store credits issued by Emberz:

  • Are not redeemable for cash unless required by law

  • Are non-transferable and may not be resold

  • Must be redeemed in accordance with their stated terms

 

Emberz is not responsible for lost, stolen, damaged, or unauthorized use of gift cards or store credit.

Store credit may be issued at Emberz’s discretion for returns, promotions, or customer service resolutions and may be subject to expiration, restrictions, or revocation.

 

Fraudulent use, chargeback abuse, or policy violations may result in cancellation of gift cards or forfeiture of store credit without compensation.

 

21.3 Promotions / Coupons

Promotions may have limits, exclusions, one-time use restrictions, expiration, product/category exclusions, and may be modified or ended at any time.

 

21.4 Gifts With Purchase

GWP offers are limited, while supplies last, and may require qualifying items/order totals. If qualifying items are removed or canceled, GWP eligibility may be removed.

22.) Subscriptions & Recurring Purchases

Emberz may offer subscription-based or recurring purchase programs (“Subscriptions”).

By enrolling, you authorize Emberz to charge your designated payment method on a recurring basis according to the disclosed frequency, pricing, and terms.

 

Subscriptions may include:

  • Automatic renewals

  • Product substitutions due to availability or regulatory requirements

  • Pricing changes with notice where required by law

You may modify or cancel Subscriptions prior to the applicable billing cutoff. Emberz is not responsible for interruptions caused by inventory, compliance issues, payment failures, or force majeure events.

Emberz reserves the right to modify or discontinue Subscriptions at its discretion.

 

23.) Deposits, Prepayments, & Amounts Owed

23.1 Deposits, Prepayments, & Partial Payment

Emberz may require deposits, prepayments, partial payments, or full payment in advance for certain products, services, programs, events, experiences, special orders, reservations, layaway arrangements, or custom offerings.

Unless expressly stated otherwise in writing:

  • All deposits are non-refundable to the fullest extent permitted by law.

  • Deposits may be forfeited if you cancel, fail to appear, fail to complete payment, violate policy, or do not comply with booking, pickup, or participation requirements

  • Payment of a deposit does not guarantee availability, approval, or fulfillment unless expressly confirmed by Emberz in writing.

  • Deposits may be applied toward the total balance owed where applicable

23.2 Service and/or Order Cancellations, Changes, Fees & Surcharges 

Requests to cancel, modify, reschedule, or change an order, booking, reservation, service, event, experience, or program participation are not guaranteed and may be subject to additional fees, surcharges, restocking fees, administrative fees, or cost recovery charges, where applicable.

 

Such fees may apply based on, without limitation:

  • The timing of the request

  • The fulfillment or preparation stage

  • Supplier or third-party costs incurred

  • Restocking, handling, preparation, or labor expenses

  • Missed appointments, no-shows, or late changes

Any applicable fees may be deducted from deposits, prepayments, or refunds (where refunds are permitted by law). Emberz reserves the right to assess, waive, or adjust such fees at its sole discretion, subject to applicable law.

 

23.3 Right To Reallocate Deposit(s) and/or any other Prepaid Funds

Emberz reserves the right to apply deposits toward:

  • Cancellation fees

  • Restocking, preparation, or administrative costs

  • Missed appointments or no-shows

  • Damages, losses, or policy violations where permitted by law

 

23.4 Customer Debt Settlement Responsibility

You agree to pay all amounts owed to Emberz in connection with purchases, bookings, services rendered, layaway balances, subscription charges, event participation, or other obligations. Outstanding balances must be paid in full according to the terms disclosed at the time of purchase or booking.

 

Failure to pay amounts owed may result in:

  • Cancellation of orders, bookings, or services

  • Forfeiture of deposits or prepayments

  • Suspension or termination of accounts or program access

  • Refusal of future service

  • Collection efforts where permitted by law

 

Emberz reserves the right to modify deposit requirements, payment schedules, and eligibility criteria at its discretion, subject to applicable law.

 

Deposits and amounts owed are subject to Emberz’s discretion and enforcement rights as outlined in these Terms, including abuse prevention and refusal of service provisions.

24.) Loyalty, Rewards & Promotions (Emberz Memberz)

Participation in Emberz Memberz Rewards, loyalty programs, promotions, giveaways, credits, or special offers is voluntary and subject to additional terms, eligibility requirements, and program rules.

Points, rewards, credits, gift balances, or perks:

  • Have no cash value unless explicitly stated

  • Are non-transferable and may not be resold or exchanged

  • May expire, be forfeited, or be revoked due to inactivity, abuse, suspected fraud, or account closure

  • May not be combined with other offers unless expressly permitted

 

Emberz reserves the right to modify, suspend, or terminate any rewards program, promotion, gift, or benefit at any time, with or without notice, and without liability.

Abuse, manipulation, or exploitation of rewards systems—including multiple accounts, false information, return abuse, or fraudulent activity—may result in forfeiture of points, suspension, termination, or permanent disqualification.

 

25.) Vape Loyalty Card / Program

Emberz may offer a vape-specific loyalty card or rewards program (the “Vape Loyalty Program”) that allows eligible customers to earn rewards based on qualifying disposable vape purchases, subject to applicable laws and program rules. 

 

Participation in the Vape Loyalty Program is voluntary and limited to individuals who meet all legal age and eligibility requirements. The program may be subject to purchase limits, exclusions, verification requirements, and regulatory restrictions.

 

25.1 Program Structure

  • Customers earn one (1) Emberz flame stamp for each eligible disposable vape purchased.

  • Buy nine (9) eligible disposable vapes, get the tenth (10th) vape free.

25.2 Eligible Purchases (Earning Stamps)

  • All disposable vapes earn stamps, including but not limited to Airis, Al Fakher, EBCreate, Foger, Lost Mary, and equivalent disposable vape products, as determined by Emberz.

  • Rechargeable disposable vapes earn stamps but are excluded from reward redemption.

  • Emberz reserves the right to determine product eligibility, equivalency, and stamp qualification at its sole discretion.

25.3 Reward Redemption (Free Vape)

The free tenth (10th) vape reward is strictly limited to:

  • Stick-style disposable vapes only (Airis or equivalent)

  • Brand, model, and variant selected solely by Emberz

Customers may not substitute, upgrade, exchange, or request alternative products. Rechargeable disposable vapes are excluded as rewards.

Rewards have no cash value, are non-transferable, and may not be exchanged for store credit, discounts, or other products.

25.4 Lost Cards & Replacement Policy

Lost, stolen, or damaged loyalty cards will not be replaced with previously earned stamps under any circumstances.

If a loyalty card is lost, the customer must request a new card and restart stamp accumulation from zero.

25.5 Missing Stamp Claims

  • Missing stamps may be added only with valid proof of purchase, and only if the qualifying purchase was made within seven (7) calendar days prior to the date the claim is submitted.

  • Claims submitted after the seven (7) day period will not be considered, regardless of circumstance.

  • Emberz reserves the right to verify purchases and deny claims where proof is insufficient, altered, or inconsistent.

25.6 Program Limitations & Enforcement

The Vape Loyalty Program is voluntary and subject to change or discontinuation at any time without notice.

25.7 Vape Loyalty Program rewards, credits, punches, or benefits:

  • Have no cash value unless expressly stated

  • Are non-transferable and may not be sold, traded, or exchanged

  • May expire, reset, or be forfeited

  • May be modified, suspended, or discontinued at any time

  • May not be substituted or redeemed outside the program rules

25.8 Abuse, manipulation, or misuse of the Vape Loyalty Program

This includes but is not limited to false information, multiple cards, false claims, circumvention of limits, multiple accounts, attempts to exploit the reward structure, or attempts to bypass age or regulatory requirements—may result in:

  • Forfeiture of stamps or rewards

  • Suspension or termination of participation

  • Permanent disqualification from the program

  • Account restrictions,

  • Refusal of service

All program decisions made by Emberz are final.

26.) Stash Cash Layaway Program (General Terms)

The Stash Cash Layaway Program is an Emberz-created, fully in-house layaway option that allows eligible Emberz Rewards Members to reserve select items and pay for them over time through incremental payments made directly to Emberz.

 

This program is not financing, not credit, and not a loan. It involves no interest, no credit checks, and no third-party lenders.

Layaway is subject to:

  • Eligibility rules

  • Payment schedule requirements

  • Non-refundable fees where posted

  • Cancellation/forfeiture rules where posted and/or indicated 

  • Inventory availability and management approval

  • Failure to comply may result in cancellation and loss of certain benefits as allowed by law and posted rules.

27.) Emberz Flame Guard / Glass Protection Plan (General Terms)

The Emberz Glass Protection Plan is an optional add-on governed by its own posted FAQ/policy rules, including: eligibility, tiers, maximum covered values, claim limits, non-transferability, approval standards, and exclusions.

Purchasing the plan does not guarantee claim approval.

The plan is not an insurance policy unless Emberz expressly states otherwise.

 

Claims require proof of purchase and account verification.

  • User-submitted content grants Emberz a non-exclusive, royalty-free license to display and moderate such content.

  • Certain offerings may be limited, invite-only, request-based, reservation-based, or subject to scheduling, deposits, cancellations, or minimum requirements.

  • Emberz reserves the right to modify, suspend, restrict, reschedule, or discontinue any program, perk, experience, or offering at any time, with or without notice, and without liability.

The Smoke Society is Emberz’s community experience designed to bring together members around culture, conversation, creativity, and shared interests connected to the Emberz brand. It is a digital-first community space that allows members to engage beyond shopping — through posts, discussions, cultural highlights, and curated content.

 

The Smoke Society is an extension of Emberz’s culture, not a marketplace.

The Smoke Society community experience is subject to rules and moderation:

  • Emberz may monitor, moderate, restrict, remove content, and revoke access.

  • Harassment, hate speech, threats, spam, solicitation, impersonation, illegal content, and abuse are prohibited.

  • Violations may lead to removal, suspension, termination, or banning.

31.) Emberz Radio & Culture Programs

Emberz Radio is the Emberz branded in-house culture and music platform spotlighting certified fire artists, emerging sounds, and creative drops that align with the Emberz brand.

  • Submissions may be accepted for consideration, but Emberz may also select artists independently.

  • Being featured does not offer or guarantee compensation, future features, or commercial results.

  • Emberz may rotate content, archive features, and determine fairness (including limiting repeat features).

  • If an artist is featured again, Emberz may require new music unless Emberz authorizes otherwise.

32.) Emberz Hall of Fame (Curated; No Payments)

The Emberz Hall of Fame is a curated archive for artists/music featured on Emberz Radio and also notable Emberz moments (events, products, cultural highlights) worth enshrining.

  • Inclusion is solely chosen by Emberz.

  • No one may pay for inclusion.

  • Being included does not guarantee future inclusion or benefits.

  • Emberz may edit, remove, or update Hall of Fame content at its discretion.

33.) The Emberz Smoke Museum (Public Digital Gallery)

The Emberz Smoke Museum, also referred to as the Emberz Museum of Smoke, is Emberz’s digital gallery dedicated to visual and cultural expression inspired by smoke, fire, energy, atmosphere, and related creative themes.

 

It is a publicly accessible online experience available to all visitors and is designed to showcase the artistic and cultural side of the Emberz brand — beyond retail products alone.

  • It is not a storefront by default.

  • Content may rotate, be revised, or be removed.

  • Inclusion is not paid or sponsored.

  • Ownership and usage rights are governed by Section 37 (User Content, Reviews & Community Conduct) and Section 38 (Intellectual Property).

34.) Customer Service & MVP Treatment

34.1 Customer Support Scope

  • Customer Support can help with: order status, basic product info, account help, navigation, and policy guidance.

To the fullest extent permitted by law, Emberz limits total liability for any claim shall not exceed the greater of $100 or the amount paid by you to Emberz in the prior 60 days for the product or service giving rise to the claim.
