These Terms & Conditions (“Terms”) constitute a legally binding agreement governing all access to and use of the Emberz website, online store, physical retail location(s), rewards programs, membership features, blog, community functions, concierge services, events, marketing campaigns, and all related services and offerings (collectively, the “Services”) operated by Emberz Retail LLC, doing business as Emberz Smoke Shop and Emberz (“Emberz,” “we,” “us,” or “our”).

Any mail, legal notices, or correspondence must be addressed only to the address listed above. Any other address obtained from third parties, search engines, social media, or unofficial sources is not affiliated with Emberz Retail LLC.

1.) AGREEMENT TO TERMS & USE AT YOUR OWN RISK

By accessing, browsing, registering, purchasing from, participating in, attending, or otherwise interacting with emberzct.com, Emberz’s physical retail location, or any Emberz services (collectively, the “Services”), you acknowledge that:

Your access to and use of the Services is at your own risk
Your use is subject to these Terms & Conditions and all applicable laws
You have read, understood, and agree to be bound by these Terms in full

If you do not agree, you must not use the Services.

This website is not intended for children under the age of 18.

2. LEGAL STATUS, OWNERSHIP & AUTHORIZATION

Emberz Retail LLC is a United States–based, U.S. citizen–owned business and is legally authorized to operate in the State of Connecticut, including operating a retail establishment, selling authorized products, and collecting and remitting applicable sales taxes.

All products offered for sale—whether online or in person—are products Emberz is legally authorized to sell under applicable federal, state, and local laws. Emberz does not knowingly sell illegal, prohibited, counterfeit, or unauthorized products.

3. AUTHORIZED PRODUCT CATEGORIES

Emberz may sell lawful specialty retail products including, but not limited to:

Apparel and branded merchandise
Tobacco products, cigarettes, cigars, and RYO (roll-your-own) products
Nicotine products
Vape products and disposable vapes
Pipes, bongs, glass products, and hookah products
Smoke accessories and smoking-related tools
Lighters and ignition devices
Electronic products and accessories
Cleaning and maintenance supplies
Prepackaged snacks, candy, and beverages
Other lawful specialty retail items

The inclusion of any product category does not guarantee availability, legality in all jurisdictions, or fulfillment eligibility.

4. NO CANNABIS / THC PRODUCTS

Emberz is not a licensed cannabis dispensary or cannabis retailer.

Emberz does not sell marijuana, cannabis, THC, delta-8, delta-9, or any “weed” products. Emberz will not source, special-order, or carry cannabis products.

Any attempt to solicit illegal or unauthorized products may result in refusal of service, account termination, and reporting to authorities where permitted or required by law.

5. LEGAL ADULT USE ONLY (GLOBAL RULE)

All products sold by Emberz are intended solely for legal adult use.

Smoking any substance may pose health risks
Keep out of reach of children and pets
Must be used in compliance with all local, state, and federal laws

Unless a product is explicitly labeled and marketed as food or beverage, it is not edible and not intended for ingestion, inhalation, absorption, or human consumption.

You are solely responsible for determining whether a product is legal, appropriate, and safe for your use.

6. AGE REQUIREMENTS & ID VERIFICATION

21+ required for age-restricted or regulated products

18+ minimum for non-restricted products (subject to state law)

Valid government-issued photo identification is required for in-store purchases and pickup of age-restricted products. Emberz reserves the right to refuse service if identification is invalid, expired, altered, or cannot be verified.

7. PICKUP-ONLY PRODUCTS (REGULATED ITEMS)

Certain products may be purchased online but must be picked up in person by the original buyer.

Conditions:

Buyer must appear in person
Buyer must be 21+
Valid government-issued ID required
ID must match order details

No third-party pickups or “straw purchases” under any circumstances. Failure to comply voids fulfillment eligibility.

8. PRICING, PRICE CHANGES & NO PRICE GUARANTEE

All pricing for products, services, event offerings, packages, and promotions is subject to change at any time without notice.

Prices may fluctuate due to product availability, popularity, market trends, supplier pricing changes, MSRP adjustments, sales, promotions, markups, or management discretion.

If a customer was quoted a price but did not complete the purchase at that time, Emberz is not obligated to honor that price at a later date.

Any price matching or honoring of a prior price:

Is never guaranteed
Is solely at management discretion
Will only be considered within 24 hours of the original price being communicated

9. ORDERS, ACCEPTANCE & ERRORS

Order confirmation does not constitute acceptance. Emberz reserves the right to cancel or limit orders due to pricing errors, inventory issues, compliance concerns, fraud risk, operational limitations, or for any other reason at the discretion of the Emberz management team.

10. SHIPPING, PICKUP & DELIVERY

Free in-store pickup is available on eligible products
Nationwide shipping is available on select products and product categories
Local delivery is not offered

Shipping eligibility is determined by product type, destination, carrier restrictions, platform capabilities, and applicable law. Shipping rates are calculated and displayed at checkout and are subject to change. Visit our Shipping & Order Fulfillment information page for more details.

10.1 Platform Fulfillment Limitation (Wix Checkout)

Due to limitations of the Wix eCommerce platform, customers cannot select multiple fulfillment methods within a single order.

Specifically:

At checkout, customers must select one fulfillment method for the entire order
If Store Pickup is selected, it applies to all items in the cart
If Shipping is selected, shipping charges apply to all items in the cart
Wix does not allow a combination of shipping and in-store pickup within the same order

10.2 Separate Orders Required for Mixed Fulfillment

If a customer wishes to:

have one item shipped, and
pick up another item in store,

the customer must place two separate orders, each using the desired fulfillment method.

Emberz does not have the ability to override, split, or manually adjust fulfillment methods within a single online order.

10.3 Shipping Tracking & Insurance

All eligible shipped orders include:

Shipment tracking, provided once the order is processed and handed off to the carrier
Shipping insurance, included to help protect against loss or damage during transit, subject to carrier terms, conditions, and claim procedures

Tracking information will be provided via email or through the customer’s account, where available.

10.4 Risk of Loss

Risk of loss transfers:

upon successful in-store pickup, or
upon carrier acceptance and confirmation of shipment,

to the fullest extent permitted by law.

Emberz is not responsible for delays, interruptions, or failures caused by carriers, weather, force majeure events, or circumstances beyond its control.

11. PAYMENTS, TAXES & CHARGEBACKS

Accepted Payment Methods

In-store: Cash, Debit Card, Credit Card
Online: Debit Card, Credit Card

You are responsible for all applicable taxes and fees.

Improper chargebacks, false disputes, or payment abuse may result in account termination, forfeiture of rewards, fraud reporting, civil recovery, and legal action.

12. RETURNS & TERMS OF SALE

ALL SALES ARE FINAL.

No returns or refunds are accepted except for factory-defective electronics reported within 24 hours of purchase or delivery, with original receipt and packaging, as outlined in Emberz’s posted Refund Policy & Terms of Sale.

13. HEALTH, TOBACCO & NICOTINE WARNINGS

SURGEON GENERAL WARNING: Tobacco smoke increases the risk of lung cancer, heart disease, and emphysema.

NICOTINE WARNING: This product contains nicotine. Nicotine is an addictive chemical.

14. USER CONDUCT & ACCEPTABLE USE

You agree to use the Services lawfully and respectfully.

Prohibited conduct includes, but is not limited to:

Harassment, threats, abuse, hate speech, or foul language
Impersonation or deception
Fraud, chargeback abuse, or rewards manipulation
Circumventing age verification or safeguards
Disrupting website security or operations
Posting unlawful, misleading, or harmful content

Violations may result in immediate suspension or termination.

15. INTELLECTUAL PROPERTY RIGHTS

All content on the Services, including text, images, graphics, logos, trademarks, trade dress, videos, layouts, and branding, is owned by or licensed to Emberz Retail LLC and protected by U.S. and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.

Unauthorized use may result in termination and legal action.

16. RIGHT TO REFUSE SERVICE, BAN USERS & ACCOUNT CONTROL

To the fullest extent permitted by law, Emberz expressly reserves the right to:

Refuse service in person and online
Deny or cancel orders
Ban individuals from physical locations
Suspend, restrict, or permanently terminate user accounts
Deactivate or revoke Emberz Memberz™ rewards accounts
Block access to the Services

This may occur with or without notice and with or without explanation.

17. TERMINATION & EFFECT OF TERMINATION

Emberz may terminate or suspend access to the Services at any time.

Upon termination:

Accounts and rewards may be permanently disabled
Points and benefits may be forfeited without compensation
Emberz retains all legal rights and remedies

18. FRAUD & LAW ENFORCEMENT

Fraud includes payment fraud, chargeback abuse, ID misuse, rewards manipulation, pickup fraud, or false defect claims.

Emberz reserves the right to pursue all available legal remedies, including pressing charges and civil recovery.

19. EMBERZ MEMBERZ™ PROGRAM

Participation is an optional privilege and subject to the sole discretion of Emberz Retail LLC.

Program benefits:

Have no cash value
May change, expire, or be discontinued
May be revoked for abuse or violations

20. EVENTS, PROMOTIONS & MARKETING CAMPAIGNS

Emberz may organize, host, or participate in events, promotions, giveaways, contests, or marketing campaigns.

Participation is voluntary and at your own risk. Events may be modified or canceled at any time.

By participating, you grant Emberz permission to use your image or likeness for promotional purposes, to the fullest extent permitted by law.

21. NO ENDORSEMENT / NO AGENCY

The sale, display, or promotion of any product does not constitute endorsement, sponsorship, certification, or guarantee.

Emberz is an independent retailer and does not act on behalf of any third-party brand unless expressly stated in writing.

Marketing and promotional content is provided for informational and promotional purposes only.

22. PRODUCT IMAGES, DESCRIPTIONS & INFORMATION DISCLAIMER

Product images are provided for reference only and may include Emberz-taken photos, manufacturer images, third-party sourced images, enhanced imagery, or AI-generated images.

Actual products may vary slightly in appearance, color, packaging, or style.

Product descriptions and specifications may be sourced from manufacturers, importers, vendors, wholesalers, or public sources and may not be 100% accurate.

23. PRODUCT SOURCING, SUPPLIERS & THIRD-PARTY FULFILLMENT

Emberz sources its products through a variety of lawful channels, which may include, but are not limited to:

authorized manufacturers
distributors and wholesalers
importers
third-party vendors and fulfillment partners
drop-ship suppliers

Some products offered for sale may be fulfilled directly by third-party vendors or drop-ship partners on behalf of Emberz.

Important Clarifications:

Product availability, packaging, shipping origin, and delivery timelines may vary depending on the supplier or fulfillment method
The use of drop-ship or third-party fulfillment does not affect the legality, authorization, or intended adult use of any product
Emberz remains the retailer of record for products sold through its website unless otherwise expressly stated

Emberz does not guarantee the continued availability of any specific product, supplier, or fulfillment method and reserves the right to change sourcing or fulfillment practices at any time without notice.

24. CUSTOMER CARE, PRIVACY & DATA SHARING

Emberz does not sell customer personal information.

By making an online purchase from emberzct.com or in person at the physical Emberz Smoke Shop store location, you understand and agree that Emberz may share information about you and your transaction with third parties solely for legitimate business purposes, including:

Payment processing
Fraud prevention
Credit card authorization
Vendor or manufacturer direct shipping
Order fulfillment and logistics

Customer information may also be used internally for operations, analytics, marketing communications, and rewards administration.

25. WHOLESALE & BULK INQUIRIES

Wholesale, bulk, or business inquiries are subject to approval at Emberz’s discretion. Submission of an inquiry does not constitute a contract. Separate agreements may apply.

26. ASSUMPTION OF RISK

All products are purchased and used at your own risk. Emberz is not responsible for injury, damage, loss, or outcomes resulting from use, misuse, or modification.

27. RELEASE OF LIABILITY

To the fullest extent permitted by law, you release Emberz Retail LLC, its owners, employees, and affiliates from all claims arising from product purchase, possession, use, or participation in the Services.

28. COVENANT NOT TO SUE

You agree not to bring legal claims against Emberz except where prohibited by law.

29. INDEMNIFICATION & LEGAL FEES

You agree to defend, indemnify, and reimburse Emberz for all claims, damages, losses, and legal costs arising from your actions or violations of these Terms.

30. DISCLAIMER & LIMITATION OF LIABILITY

All products and Services are provided “AS IS” and “AS AVAILABLE.”

Emberz’s total liability shall not exceed the greater of $100 or the amount paid by you in the prior 60 days.

31. GOVERNING LAW & VENUE

These Terms & Conditions are governed by the laws of the State of Connecticut. Exclusive jurisdiction and venue lie in the state or federal courts located within Connecticut.

32. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

33. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Emberz Retail LLC regarding your use of the Services and supersede all prior or contemporaneous communications, whether written or oral.

No statement by any Emberz employee or representative shall modify these Terms unless authorized in writing by Emberz management.

34. CHANGES TO TERMS

Emberz reserves the right to modify these Terms at any time without prior notice. Changes will be posted on emberzct.com. Continued use constitutes acceptance.
